La mediación en Ecuador: vía idónea para solucionar conflictos en torno al ambiente

Resumen: Este estudio destaca a la mediación como una vía competente en la que se aproxima a los conflictos relacionados con el ambiente, de esta manera se fomenta la participación eficaz de las comunidades para encontrar soluciones que respeten el ambiente. Este planteamiento nos ayuda a resolver disputas, sino que también asiste a aportar soluciones para aclarar los conflictos, de esta manera también contribuye a la restauración de relaciones y al levantamiento de un sistema de justicia más asequible e imparcial en el Ecuador, para beneficio del Derecho Ambiental. La mediación en el Ecuador se ha convertido en una estrategia provechosa para la solución de controversias, especialmente aquellos que se comprometen con aspectos ambientales, fomentando de esta manera un tratamiento colaborativo y acertado en el diálogo. Abstract: This study highlights mediation as a competent way to approach conflicts related the environment, thus promoting the effective participation of communities to find solutions that respect the environment. This approach helps us resolve disputes, but also helps to provide solutions to clarify conflicts, in this way it also contributes to the restoration of relationships and the creation of a more affordable and impartial justice system in Ecuador, for the benefit of the citizens. Mediation in Ecuador has become a profitable strategy for resolving disputes, especially those that are committed to environmental aspects, thus promoting collaborative and accurate treatment in dialogue.

THE RIGHTS OF CROSS-BORDER WORKERS: SOCIOECONOMIC AND LEGAL REALITY ON THE ECUADORIAN BORDER

Workers who work in the territory of one Member State and reside in the territory of another Member State, to which they return every day, or at least once a week, are known as cross-border workers. But this way of working also has its drawbacks. The situation can be complex for both the worker and the employer. For the worker, these are inconveniences that can lead to divorce, estrangement, expenses, etc. For companies, the inconveniences include controlling travel expenses, complying with immigration laws, ensuring social security and reaching an agreement with the employee on the days to be spent at work and at home. The objective of this research is to analyze the judicial competence and the principle of effective judicial protection to protect and guarantee the rights of cross-border dependent and self-employed workers. When there are labor disputes between the employer and the workers, which border country is responsible for regularizing these rights? NATURE AS SUBJECTS OF RIGHTS, ANALYSIS OF JUDGMENT 185-20JP/21

This article addresses the legal issue of recognizing nature as a subject of rights within the current legal framework, highlighting a paradigm shift in the protection of nature in Ecuador. With the 2008 Constitution, nature transitioned from being an "object of protection" to an entity with its own rights. The ruling 1185-20-JP/21 is used as a case study to analyze these legal and practical implications. The ruling deals with the violation of rights due to irrigation projects without adequate environmental consultation, emphasizing the importance of ecological flow. The Constitutional Court reaffirms the interdependence between the rights of nature and human rights, highlighting the need for a systemic approach to environmental protection. Key legal and jurisprudential precedents are reviewed to contextualize this recognition, evaluating its impact on the legal system and environmental protection, and analyzing the enforceability of these rights through judicial mechanisms. The ruling establishes a crucial precedent for the sustainable management of natural resources and reinforces the importance of protecting the rights of nature to ensure a sustainable future for all generations

Ecuador una tierra de contrastes: análisis sobre el bienestar animal en la producción ganadera ecuatoriana y los derechos de la naturaleza

The Constitution of the Republic of Ecuador introduces a new perspective regarding environmental protection within the context of an economic, social, and solidarity development model. This approach becomes particularly relevant in addressing animal rights, initiating discussions that have opened new avenues in recognizing their rights as sentient beings. However, substantial success has not been achieved in materializing these rights within the legal framework and in generating effective policies that ensure humane treatment of animals and sustainably improve access to healthy food and sustainable production systems, in line with the social and environmental responsibility of solidarity economy organizations. The objective of this work is to conduct a critical review of animal protection policies within the context of the rights of nature, particularly in livestock production in Ecuador. The aim is to examine how these issues are being addressed, identify existing limitations, and propose possible pathways to progress towards a more just and sustainable balance between economic development, environmental protection, and animal welfare in the Ecuadorian livestock sector.
