EQUALITY AND NON-DISCRIMINATION IN THE RIGHT TO WORK IN THE PUBLIC AND PRIVATE SPHERES

This article constitutes a journey from the appearance of the Right to work, as part of the fundamental economic, political and social rights. The objective is to analyze the relationship of the right to work with the civil rights of equality and non-discrimina-tion in Ecuadorian legislation, focusing on the differences between public and private servants; whose differences could be considered violations of the principle of equality, constant in international agreements, ratified by Ecuador and incorporated into the Ecuadorian legal framework. The research has been carried out from a qualitative approach, therefore, own methods have been applied, such as documentary, descriptive, analytical, which served to extract the best definitions and opinions on the subject matter, managing to determine that the right to work in Ecuador, runs the risk of being a simple statement, lacking in effectiveness that has not achieved due legal protection, dragging political, economic and social implications, which keep society in a vicious circle of poverty and underdevelopment; therefore, if you want to overcome the economic deficit and the generalized social crisis, you must start by respecting and guaranteeing equality in the right to work. © 2022, University of Cienfuegos, Carlos Rafael Rodriguez.
